AI knowledge base for notaries when someone asks about the escrow instruction and the wording used back then.

Deeds, draft contracts, escrow files and probate documents in one place, every answer with its source. Your own instance on servers in Germany, the language model in an EU data centre, no training on your data. The demo uses sample documents; you find out whether the answers hold up for your files in the first weeks after go-live.

Everyday question

“Under what condition may funds be paid out of this escrow?”

The answer is in

Escrow instruction · correspondence on the transaction

Day to day

Sound familiar?

  • Is there a priority ranking notice (Rangordnung) on this property, and when does the year run out? There’s only one copy of the court order, and it’s somewhere in the file.

  • The condition for paying out the funds is in the escrow instruction – and that’s an attachment to an email from last year.

  • The trainee notary is looking for how we worded the right of residence in a transfer agreement years ago.

Tuesday, ten o’clock: recording an estate. The widow sits across from you with a folder she has brought along: two savings books, an insurance policy, a land register extract from 2014. In passing she mentions that her husband “did something with the house at the notary’s” back then – at your office, perhaps twelve years ago. Whether that was a transfer agreement or a gift in contemplation of death changes what goes into the record of the estate and, later, into the inventory. The trainee notary searches the deed collection but knows neither the deed number nor the year, and the widow’s surname isn’t the name on the contract. In the afternoon a client wants to transfer her GmbH share to her daughter. Nobody knows offhand whether the 2009 articles of association contain a pre-emption clause (Aufgriffsklausel) or how it’s worded; the minutes of the last general meeting are a scan in a folder set up by someone who no longer works at the office.

Getting started

Where to start

Start with the draft contracts and internal notes, not the deed collection. That’s where the drafting work lies that your office asks about every day, and where you’ll quickly see in the first weeks after go-live whether the answers and sources are any good – ideally using wordings you could find again yourself. Escrow files and probate documents come second. Until then, you upload files yourself – individual files, whole folders, emails with attachments, scans from the working file. Before we start, we check whether your filing system and mailbox can be connected; setting it up is charged on a time-and-materials basis, agreed in advance.

FAQ

Frequently asked questions

We handle escrows through the escrow register and the Notartreuhandbank. What happens to that?

Nothing. Nothing is connected to the Austrian notaries’ escrow register or to the accounts; only your own files go into the knowledge base – the written escrow instruction, the correspondence on the transaction, the proof that the condition has been met. You still register the escrow under § 109a of the Notarial Code (Notariatsordnung) yourself, and must do so before the third-party assets are first disposed of. The knowledge base sends nothing and reports nothing; it answers questions and creates drafts on request.

Does the system remind me of the priority ranking year?

It doesn’t remind you of anything on its own – it answers when you ask. Ask about a property and the answer gives the priority ranking order with date and source, provided it’s in the knowledge base; if the system finds none, it tells you so. The assessment stays with you: under § 55 GBG (Land Register Act), the notice ceases to have effect one year after it was granted, and the calendar day on which this period ends must be stated in the order itself. So the date is on the very document you’re looking for – the knowledge base can lead you to it, but the deadline remains your responsibility.

How do I find a wording again when I know neither the deed number nor the year?

You ask in your own words – right of residence, retirement maintenance (Ausgedinge), value protection clause, prohibition on encumbrance and sale, pre-emption clause. The search runs on the content of the documents, not on file names or folder structure; a name, a property or a set of facts can be enough to start with. Every answer comes with its source: which draft version, which deed, which date. In the first weeks after go-live, try an example you know to see whether the wording you have in mind turns up. If the system finds nothing, it tells you so.

Can it produce a draft for a record of the estate or an inventory?

Yes, a draft – as a Word file, Excel spreadsheet, PDF or email draft, with the documents the details come from. What has to go into the record of the estate is set out in § 145 AußStrG (Non-Contentious Proceedings Act), not by our software; the recording itself and the responsibility as court commissioner remain with you. Nothing is filed, signed or sent. If a document or an approval is missing, it goes into the draft as an outstanding point – you’ll see what that looks like in the first weeks after go-live, using a closed probate case.
